In the Matter of ARMOUR & COMPANY and AMALGAMATED MEAT CUTTERS AND BUTCHER WORKMEN OF NORTH AMERICA, LOCAL No. 235 Case No. R-1040 CERTIFICATION OF REPRESENTATIVES February 28, 1'939 On December 30, 1938, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' The Direction of Election provided that an election by secret ballot be held among the production and main- tenance employees of Armour & Company, Spokane, Washington, who were employed during the pay-roll period of October 1, 1938, including extra employees, but excluding supervisors, clerical em- ployees, truck drivers, watchmen, extra hide employees, and those who had since quit or been discharged for cause, to determine whether they desired to be- respresented by Amalgamated Meat Cutters and Butcher Workmen of North America, Local No. 235, or by United Packing House Workers Local Industrial Union No. 763, for the purposes of collective bargaining, or by neither. Pursuant to the Direction of Election, an election by secret ballot was conducted under the direction and supervision of the Regional Director for the Nineteenth Region (Seattle, Washington) on Jan- uary 11, 1939. Full opportunity was accorded to all the parties to this investigation to participate in the conduct of the secret ballot and to make challenges. On January 25, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 1, as amended, issued and duly served upon the parties an Intermediate Report on the election. No objections or exceptions to the Intermediate Report have been filed by any of the parties. I. 0--------------------------------------------- 64 Total number of votes in favor of neither------------------ 44 Total number of blank ballots--------------- -------------- 0 Total number of void ballots----------------------------- 0 Total number of challenged ballots----------------------- 0 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations- Series 1, as amended, IT IS HEREBY CERTIFIED that Amalgamated Meat Cutters and Butcher Workmen of North America, Local No. 235, has been se- lected by a majority of the production and maintenance employees of Armour & Company, Spokane, Washington, including extra em- ployees, but excluding supervisors, clerical employees, truck drivers, watchmen, and extra hide employees, as their representative for the purposes of collective bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Amalgamated Meat Cut- ters and Butcher Workmen of North America, Local No. 235, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
