In the Matter of KINGAN & Co., INCORPORATED and UNITED MEAT PACKING WORKERS , LOCAL INDUSTRIAL UNION No. 117 Case No. R-1371 CERTIFICATION OF REPRESENTATIVES August 17, 1939 On May 27, 1939, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above- entitled proceeding.' On July 20, 1939, the Board issued a Supple- mental Decision and Direction of Election.2 The Supplemental Decision and Direction of Election provided that an election by secret ballot be conducted within fifteen (15) days from the date of the Direction among the production employees of Kingan & Co., Incorporated, herein called the Company, at its Indian- apolis, Indiana, plant, whose names appeared on the Company's April 29, 1939, pay roll, including employees who did not work during such pay-roll period because they were ill or on vacation, excluding super- visory, clerical, and salaried employees and all employees who had since quit or had been discharged for cause, to determine whether or not they desired to be represented for the purposes of collective bar- gaining by Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 165, affiliated with the American Federation of Labor. Pursuant to the Supplemental Decision and Direction of Election, an election by secret ballot was conducted on August 1, 1939, at Indian- apolis, Indiana, under. the direction and supervision of the Regional Director for the Eleventh Region (Indianapolis, Indiana). On Au- gust 2, 1939, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations- Series 2, issued an Election Report on the election, copies of which were duly served upon the parties. F. of L__________________________ 633 Total number of Blank Ballots_____________________________ 13 Total number of Void Ballots_____________________________ 4 Total number of Challenged Ballots -------------------------- 2 By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, IT IS HEREBY CERTIFIED that Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 165, affiliated with the American Federation of Labor, has been selected by a majority of the :production employees of Kingan & Co., Incorporated, at its Indian- apolis, Indiana, plant, excluding supervisory, clerical, and salaried ,employees, as their representative for the purposes of collective bar- gaining, and that pursuant to Section 9 (a) of the National Labor Relations Act, Amalgamated Meat Cutters and Butcher Workmen of North America, Local Union No. 165, affiliated with the American Federation of Labor, is the exclusive representative of all such em- ployees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment.
