CERTIFICATION OF REPRESENTATIVES
August 22, 1939
On July 17, 1939, the National Labor Relations Board, herein
called the Board, issued in the above-entitled case a Decision and
Direction of Election.'
The Direction of Election directed that an
election by secret ballot be conducted with fifteen (15) days from the
date of the Direction among all maintenance and production em-
ployees located in the Company's Red Ore Division including "con-
tractors" and clerical employees in the mines, who were employed dur-
ing the pay-roll period ending April 15, 1939, including employees
who had not worked during such pay-roll period because they were
ill or on vacation, but excluding supervisory employees and office
clerical employees, and employees who had since quit or been dis-
charged for cause, to determine whether they desired to be represented
by Lipscomb Red Ore Local Union No. 103 of the International Union
of Mine, Mill, and Smelter Workers, affiliated with the Congress of
Industrial Organizations, or by Red Ore Miners' Union No. 21971,
affiliated with the American Federation of Labor, for the purposes of
collective bargaining, or by neither.
Pursuant to the Direction of Election, an election by secret ballot
was conducted at Lipscomb, Alabama, on July 29, 1939, under the
direction and supervision of the Regional Director for the Tenth
Region (Atlanta, Georgia).
On August 4, 1939, the Regional Di-
rector, acting pursuant to Article III, Section 9, of National Labor
Relations Board Rules and Regulations-Series 2, issued and duly
served upon the parties an Election Report on the ballot. In his
report, the Regional Director certified that the election was fairly
and impartially conducted and that the ballots cast were duly and
fairly counted under his supervision, and that there had been filed
with him by the tellers statements to that effect.

By virtue of and pursuant to the power vested in the National
Labor Relations Board by Section 9 (c) of the National Labor Rela-
tions Act, 49 Stat. 449, and pursuant to Article III, Section 8, of
National Labor Relations Board Rules and Regulations-Series 2,
IT Is HEREBY CERTIFIED that Lipscomb Red Ore Local Union No. 103.
of the International Union of Mine, Mill, and Smelter Workers,
affiliated with the Congress of Industrial Organizations, has been
designated and selected by a majority of the maintenance and pro-
duction employees who are located in the Red Ore Division of the
Woodward Iron Company, Woodward, Alabama, including "con-
tractors" and clerical employees in the mines, but exclusive of super-
visory and office clerical employees, as their representative for the
purposes of collective bargaining and that, pursuant to the provisions
of Section 9 (a) of the National Labor Relations Act, Lipscomb Red
Ore Local Union No. 103 of the International Union of Mine, Mill,
and Smelter Workers, affiliated with the Congress of Industrial Or
ganizations, is the exclusive representative of all such employees for
the purposes of collective bargaining in respect to rates of pay, wages,
hours of employment, and other conditions of employment.
