On January 8, 1940, the National Labor Relations Board, herein
called the Board, issued a Decision and Direction of Election in the
above-entitled proceeding.'
The Direction of Election provided that
an election by secret ballot be conducted within, thirty (30) days from
the date of the Direction among all the foundry employees of Ameri-
can Scale Company and Frank Davenport, Pleasant Hill, Missouri, in-
cluding molders, core makers, helpers, and the cupola tender, and
excluding the foreman, who were employed during the pay-roll period
immediately preceding the date of the Direction, including employees
who did not work during such pay-roll period because they were ill,
on vacation, or temporarily laid off, but excluding employees who
had since quit or been discharged for cause, to determine whether or
not they desired to be represented by Local #149, International Mold-
ers Union of North America, affiliated with the American Federation
of Labor, for the purposes of collective bargaining.
Pursuant to the Direction, the election by secret ballot was held on
January 27, 1940, at Pleasant Hill, Missouri, under the direction and
supervision of the Regional Director for the Seventeenth Region.
