Objections have been filed with the Regional Director as to the
elections conducted at the Chevrolet Motor. Division, Kansas City,
Missouri, and at the Delco-Remy Division, Anderson, Indiana.
The
Regional Director has not completed his investigation of the matters
specified in the objections, and no final determination as to the elec-
tions held at these two plants will be made herein.
No objections
or exceptions have been filed by any of the parties with regard to
the remaining 65 elections covered in the Elections Report.
The results of the election at_ the Harrison Radiator Division,
Lockport, New York, show that no collective bargaining representa-
tive has been selected by a majority of the employees voting.
The
petitions for investigation and certification of representatives of the
employees of General Motors Corporation, in so far as they refer

to the Harrison Radiator Division, Lockport; New York,-will there-
fore be dismissed.
The results of the elections at the Chevrolet Motor Division;
Baltimore, Maryland, and the Fisher Body Division (Plant #40),
Detroit, Michigan, show that neither the A. F. .L.=U. A. W. nor
the C. I. 0.-U. A. W. received a majority of the valid votes cast.
The majority of employees at each of these plants have, however,
indicated a desire to bargain collectively with the Company.8
Both
the A. F. L.-U. A. W. and the C. I. O.-U. A. W. have filed with
the Regional Director requests for run-off • elections at these two
plants.
We shall direct that such run-off elections be held. In ac-
cordance with the policy enunciated by the majority of the Board
in Matter of R. K. Le Blond Machine Tool Co., Cincinnati Electrical
Tool Co. and Independent Employees Organization,9 the ballots used
in such run-off elections shall contain the names of both labor
organizations but no place in which to vote again for "neither"; 10
the organization receiving the higher number of votes to be certified;
as exclusive bargaining : representative.
Upon the entire record in these cases, the Board makes the
following:
SUPPLEMENTAL FINDINGS OF FACT
We find that the following groups of employees of General Motors
Corporation constitute units appropriate for the purposes of col-
lective bargaining, and that said units will insure to employees of
the Company the full benefit of their right to self-organization ' and
to collective bargaining and otherwise effectuate the policies of the
Act :
. (a) Wood pattern makers and model makers, working on bench
or machine (but not shaper hands), metal pattern makers working
on bench or machine, model and pattern checkers, keller model set-up
men, and the apprentices of these classifications (but not supervisory
or salaried employees and those whose work is of a confidential
nature), employed by the Company at each of the following plants:
Buick Motor Division, Flint, Michigan.
Chevrolet Motor Division, Flint, Michigan.
Fisher Body Division (Plant #23), Detroit, Michigan:
Pontiac Motor Division, Pontiac, Michigan.
Research Laboratories Division, Detroit, Michigan.
8In each of these two elections, the C. I. O.-U. A. W., the A.' F. L.-U. A. W., and,
"neither" ranked first, second , and third , respectively , in the number of votes received.

Michigan.
As stated above, however, the results of the craft elections among the pattern
makers at the first, and. among the die sinkers at the second, of these two plants have been
challenged.
We shall withhold our determination of the appropriate units at these two

DECISIONS OF NATIONAL LABOR RELATIONS BOARD
MR. WILLIAM M. LEISERs0N, concurring :
As stated in my separate opinion in the R. K. Le Blond 20 case, I
believe that the Board is not authorized by the Act to order a run-off
election.
Since, however, the majority here directs such elections, I
agree that the ballot should contain the names of the two labor organi-
zations, and no place to vote against a labor organization.
CHAIRMAN MADDEN, dissenting in part :
I dissent as to the form of the ballot directed to be used in the run-
off elections.
As I have stated in Matter of R. K. Le Blond Machine
Tool Co., Cincinnati Electrical Tool Co. and Independent Employees
Organizationl,,21 and in subsequent cases, I think the Board should
permit the eligible employees to vote, as under the Board's former
run-off election procedure, for or against C. I. O.-U. A. W., which
received a plurality of the votes in the original elections at the two
plants at which run-off elections are to be held.

Order.,° in which it disposed of all the elections which had been held
except the three mentioned above, which depended upon the -disposi-
tion made of challenged ballots; the two mentioned above, as to
which there were objections; and two others, which were held among
the production and maintenance employees at the Saginaw Malleable
Division, Saginaw, Michigan, and at the Chevrolet Motor Division
(Forge) (Spring and Bumper), Detroit, Michigan, in both of which
International Union, United Automobile Workers of America, affili-
ated with the C. I. 0., herein called the C. I. O.-U. A. W., was desig-
nated as the collective bargaining representative, but as to which
certification is withheld until it is determined whether or not the pat-
tern makers and the die sinkers, respectively, at the plants involved,
desire to be represented by the same labor organization as the pro-
duction and maintenance employees.
On May 31, 1940, the Regional Director issued and duly served upon
the parties an Amendment to Elections Report; First Supplemental
Elections Report; and Report on Objections.

DECISIONS OF NATIONAL
LABOR RELATIONS BOARD
With respect to this election, the Regional Director, reported that he
had investigated the eligibility to vote of Carroll Angle, Oswald
Braun, and Andrew J. Fisher, the three individuals whose ballots were
challenged, ruled that all three were eligible to vote, and recommended
that he be directed to open the challenged ballots and report further.
No objections to this ruling have been filed by any of the parties.
Ac-
cordingly, we shall direct the Regional Director to open these chal-
lenged ballots and to issue a further supplemental report as, to this
election.

The Regional Director reported, with respect to this election, that he
had investigated the. eligibility to vote of the 24 employees whose bal-
lots were challenged.
During the course of this investigation, two of
the challenges were withdrawn.
Two other challenged ballots were
not enclosed within the outer, envelopes provided for the purpose of
recording thereon the name of the voter, the name of the challenger,
and the reasons for the challenge, and were therefore found by the
Regional Director to be void.
The Regional Director made no ruling
as to the remaining 20 challenged ballots.'
He•reported that lie was.
unable to determine from the evidence whether or not these 20 em-
ployees were eligible to vote in this election for the reasons that, al-
though the definition of eligibility to participate in this election was
based upon a stipulation entered into by all the parties to these pro-
ceedings, the labor organizations involved differ in their interpretation
of the definition of eligibility to vote as a die sinker, and that the
7It appears that 10 of the individuals involved were named on the eligibility list
which had been prepared for the election to be held among the production and mainte-
nance employees at this plant , and not on the die sinkers' eligibility list.

viduals were given, and attempted to cast in the die sinkers ' election , ballots prepared

definition contained in the stipulation is open to either of the inter-
pretations proposed by the two labor organizations involved.,,
He
recommended that the hearing in these proceedings be reopened for the
sole purpose of permitting the parties hereto to introduce evidence
which will enable the Board to clarify the definition of the unit pro-
visionally established by the'Board, in accordance with the stipulation
of the parties, among employees generally engaged in die sinking
operations at the Chevrolet Motor Division (Forge) (Spring and
Bumper), Detroit, Michigan, and which. will enable the Board to
determine the identity of all the employees comprising such pro-
visional unit.
No objections were filed to this portion of the Supple-
mental Elections Report.
We shall adopt the Regional Director's
recommendation.

afore-mentioned employees.
II. Objections
In his Elections Report, the Regional Director reported the results
of the balloting among the production and maintenance employees

sinkers at the Buick Motor Division, Flint, Michigan, the only other plant at which a
separate craft election among die sinkers was held.

In his Report on Objections, the Regional Director reported that the
C. I. O.-U. A. W. had filed with him objections to the conduct of the
ballot in the aforesaid election and to the Elections Report in so far
as it pertained to that election.
The C. I. O.-U. A. W. has requested
oral argument before the Board on its objections.
Such objections
allege (1) that campaign literature, telegrams, and information sent
to the Kansas City office of the C. I. O.-U. A. W. were delivered to
and retained by the Kansas City office of International Union, United
Automobile Workers of America, affiliated with the A. F. of L.,
herein called the A. F. L.-U. A. W., and that, if the C. I. 0.-
U. A. W. had not been thereby prevented from distributing such
material to the employees at the Kansas City plant, such employees
would have voted. for the C. I. O.-U. A. W.; (2) that the A., F. L.-
U. A. W., in violation of a pre-election agreement with the C. I. 0.-
U. A. W., conducted a vigorous campaign for support on the `day of
the election by various described activities at, in, and' near the plant,
and that the acts complained of improperly influenced employees to
vote for the A. F. L.-U. A. W.; and (3) that a large majority of the
employees at the Kansas City plant had stated in writing that they
had been misinformed by A. F. L.-U. A. W. officials concerning the
election, and desired a new election to enable them to vote for the
C. I. O.-U. A. W.
The Regional Director, having duly investigated the matters con-
tained in the objections of the C. I. O.-U. A. W., reported that a
package of lapel buttons designed for use in the pre-election cam-
paign, three packages of campaign literature, and three telegrams,
all addressed to and intended for the C. I. O.-U. A. W., were mis-
delivered by the Post Office Department, the Railway Express
Agency; and the. Postal Telegraph Company, respectively, to the
GENERAL MOTORS CORPORATION ,
199
A. F. L.-U. A. W., and that all of these materials were recovered by
the C. I. O.-U. A. W. prior to elections. The Regional Director
further reported that the A. F. L.-U. A. W. caused one or more auto-
mobiles or trucks bearing campaign slogans to be stationed in and
moved about streets adjoining the plant in. question during the time
the election was being conducted. -
Subsequent to the filing of its objections, and in support of its
contention that a majority of the employees involved now desire the
C. I. O.-U. A. W. to represent them, the C. I. O.-U. A. W. filed with
the Regional Director petitions bearing 567 signatures under the
following heading :
We, the undersigned employees of Chevrolet-Kansas City divi-
sion of General Motors Corporation, having been misinformed
by the U. A. W.-A. F. L. officials as to their strength in the
General Motors Plants in the N. L. R. B. vote April 17, 1940,
.and wishing to be with the majority of the General Motors
workers in their bargaining unit, now wish to become affiliated
with the bargaining unit of the U. A. W.-C. I. O. so that we may
have the maximum bargaining power, protection, and chance to
obtain a national contract:
We shall assume that the petitions bear signatures of employees
who were eligible to vote in the election, and shall consider their effect
as evidence of a post-election shift in the desires of certain of the
employees.
As. has been shown, the A. F. L.-U. A. W. received 566
votes out of 1002 validly cast,. a plurality of 147 over the C. I. 0.-
U. A. W., while 17 persons voted for neither union, one spoiled his
ballot, and 110 eligible employees refrained from voting.
Thus,
although the petitions purport to reflect a gain of 148 votes by the
C. I. O.-U. A. W., since the identity and choice of the employees who
voted does not appear, the actual shift from the A. F. L.-U. A. W.
may be as few as 20 votes. Inasmuch as the eligible voting group
totals 1113 employees, the relatively small shift reflected by the peti-
tions is, in our opinion, insufficient to warrant disturbing the results
of the election .9
The Board has fully considered the Elections Report, the Objec-
tions, and the Report on Objections, and finds that the objections do
not raise substantial and material issues with respect to the conduct
of the ballot or the Elections Report.
The objections are hereby
Compare Matter of New York d Cuba Mail Steamship Company and United Licensed
Officers of the United States of America, 2 N. L. R. B. 595, where the Board vacated an
election and ordered that a new one be held on the basis of a shift in membership. In
that case there were 40 engineers eligible to vote, of whom 34 voted for the U. L. O.
and 6 voted for the M. E . B: A.' At a hearing on protests , the M. E. B. A. introduced
in evidence cards signed by 40 engineers employed by the company applying for member-
ship in M. E.
B.
A.
Thus the shift in membership in that case was overwhelming,
whereas that alleged in connection with the election at the Kansas City plant is rela-
tively slight.
200
DECISIONS OF NATIONAL LABOR RELATIONS 'BOARD
overruled , and the request of the C. I. O.-U. A . W. for oral argument,
thereon is hereby denied.
We shall accordingly certify the A.,F. L.-
U. A. W., which received a majority of the ballots cast in the election,.
as the collective bargaining representative of the production and
maintenance employees at the Chevrolet Motor Division , Kansas
City, Missouri.
The Board does not at this time pass upon the Regional Director's:
report as to the election conducted among the production and main-
tenance employees at the Delco-Remy Division , Anderson, Indiana,
the Objections filed thereto , or the Regional Director's report on said
Objections.
Upon the entire record in these cases , the Board makes the fQl-
lowing : .
