In the Matter of BIRMINGHAM TANK COMPANY, DIVISION OF THE INGÀLLS IRON WORKS COMPANY, INC.; and INTERNATIONAL Asso- CIATION OF BRIDGE, STRUCTURAL AND ORNAMENTAL IRON WORK- ERS, SHOPMEN'S LOCAL #539 Case No R-1938 AMENDMENT TO DECISION AND DIRECTION OF ELECTION August 17, 1940 On July 31, 1940, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding,¹ in which, inter alia, it included watchmen employed by the Birmingham Tank Company, Division of the Ingalls Iron Works Company, Inc., herein called the Company, in the appropriate bargaining unit. On August 9,' 1940, the Company and the International Association. of Bridge, Structural and Ornamental Iron Workers, Shopmen's Local #539 entered into a stipulation in which they petitioned the Board to amend its: Decision and 'Direction of Election by excluding watchmen from the appropriate unit: Since watchmen were originallv included in the unit 'pursuant' to request by the Union, the only labor'organization involved in this proceeding, the Board approves the stipulation, and hereby amends its Decision and Direction of Election by striking out 'watchmen' wherever it appears therein as sêtting forth a classification of employees to bè included in the unit; and adding watchmen to the classifications of employees to be excluded from the{unit wherever such classifications appear therein?
