INTERNATIONAL UNION, LOCAL 227 Case No. R-2O71 -CERTIFICATION OF REPRESENTATIVES Feb7tary 4, 1941 On December 4, 1940, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled proceed- ing,' and on December 23, 1940, issued its Amendment to Decision and Direction of Election and Order Overruling Objections and Denying Motion for Rehearing. Pursuant to the Direction of Election an election by secret ballot was conducted on December 16, 18, 19, and 20, 1940, under the direction and supervision of the Regional Director for the Sixteenth Region (Fort Worth, Texas). On December 23, 1940, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or to the Election Report have been filed by any of the .parties. As to the balloting and its results, the Regional Director reported as follows : Total number of eligibles ----------------------------------- 186 Total number of ballots counted ---------------------------- 168 Total number of votes for Oil Workers International Union, Local 227------------------------------------------------- 107 Total number of votes against Oil Workers International Union, Local 227----------------------------------------- 61 Total number of void ballots -------------------------------- 0 Total number of blank ballots------------------------------- 0 Total number of challenged ballots---- ---------------------- 3 Since the challenged ballots could not have affected the results of the election, it is unnecessary to pass upon the challenges. By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 1 28 N L R, I3 301 29 N. B, No. 72. 397 398 DECISIONS OF NATIONAL LABOR RELATIONS BOARD 9, of National Labor Relations Board Rules and Regulations- Series 2, as amended, IT IS HEREBY CERTIFIED that Oil Workers International Union, Local 227, has been designated and selected by a majority of all employees of Houston Pipe Line Company, Houston, Texas, engaged in the operation and maintenance of its pipe lines and the services auxiliary thereto,s excluding clerical employees whose work is not directly connected with such operation and maintenance, officers and directors of the Company, department heads, and supervisory employees with full authority to hire and discharge permanent em- ployees,, as their representative for the purposes of collective bar- gaining, and that, pursuant to Section 9 (a) of the Act, Oil Work- ers International Union, Local 227, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
