SUPPLEMENTAL DECISION
AND
ORDER
February 10, 1941
On October 24, 1940, the National Labor Relations Board , herein
called the Board , issued a Decision and Direction of Election in the
above-entitled proceeding.'
Pursuant to the Direction of Election
an election by secret ballot was conducted on October 31, 1940, under
the direction and supervision of the Regional Director for the Four-
teenth Region
(St. Louis, Missouri ).
On November 2, 1940, the
Regional Director, acting pursuant to Article III, Section 9, of
National Labor Relations Board Rules and Regulations-Series 2,
as amended, issued and duly servP'l upon the parties an-:Election
Report on the ballot.
As to the balloting and its results , the Regional Director reported
as follows :

On November 8, 1940, International Ladies' Garment Workers'
Union, herein called- the Union, filed Objections to Election Report,
alleging that Forest City Manufacturing Company, herein called the
Company, by. its officers and agents engaged in certain activities be-

fore the election which interfered and,tended„to interfere with-the,,
free exercise of the will of its employees, that supervisory 'officials
of the Company caused rumors to be spread among the employees to
the effect that if they voted for the Union the Company's, operations
would decrease, and that by these and other acts, specifically set out
in its objections, the Company influenced its employees to vote against
the Union.
On January 22, 1941, the Regional Director, acting pursuant to.
Article III, Section 9, of National Labor Relations Board Rules and
Regulations-Series 2, as amended, issued a Report on Objections,
finding in effect that the objections raise no substantial and material`
issues.
We have considered the objections of the Union and the Regional
Director's Report thereon.
We are of the opinion that the objections
raise no substantial and material issues with respect to the conduct
of the election.
The objections are hereby overruled.
The. results of the election show that no collective bargaining
representative has been selected,by a majority of the employees.
The
petition for investigation and certification of representatives of em-
ployees of Forest City Manufacturing Company, St. Louis, Missouri,,
will, therefore, be dismissed..
ORDER
By virtue of Section 9 (c) of the National Labor Relations Act,
49 Stat.' 449, and pursuant to Article III, Sections 8 and 9, of
National Labor Relations Board Rules and Regulations-Series 2,
as amended,
IT IS HEREBY ORDERED that the petition for investigation and certi-
fication of representatives of employees of Forest City Manufacturing
Company, St. Louis, Missouri, filed by International Ladies' Garment.
Workers' Union be, and it hereby is, dismissed.
