On December 31, 1940, the National Labor Relations Board, herein
called the Board, issued a Decision and Direction of Election in this
proceeding."
On March 6, 1941, the Board issued a Supplemental
Decision and Direction of Run-off Election.2
Pursuant to the Direction of Run-off Election, an-election by secret
ballot was conducted on March 20, 1941, under the direction and
supervision of the Regional Director for the Twentieth Region (San
Francisco, California).
On March 22, 1941, the Regional Director,
acting pursuant to Article III, Section 9, of National Labor Rela-
tions Board Rules and Regulations-Series 2, as amended, prepared
and duly served upon the parties an Election Report setting forth
the results in the election.
No objections to the conduct of" the bal-
lot or to the Election Report have been filed by any of the parties.
As to the results of the balloting the Regional Director reported as
follows :

The Regional Director reported that inasmuch as the 12 chal-
lenged ballots could not affect the results of the run-off election, they
were not counted.

On March 28, 1941, International Woodworkers of America,-Local
6-12 filed with the Regional Director a protest to the run-off elec-
tion on the ground that it was held at a time when the Company's
,operations were curtailed and a large number of eligible employees
were- not present to vote.
The question whether the-election should-
be postponed until the Company resumed full operation was con-
sidered- fully by the Board before the original Direction of Elec-
tion issued.
None of the parties raised it in connection with the
Direction of Run-Off Election, and the difference between the num-
ber voting in the first and in the second elections was not substan-
tial.
The Board finds the protest to be without merit.
By virtue of and pursuant to the power vested in the National
Labor, Relations Board by Section 9. (c) of the National Labor Re-
lations Act, 49 Stat. 449 and pursuant to Article III, Sections 8
and 9, of National Labor Relations Board Rules and Regulations-
Series 2, as amended,
IT Is HEREBY CERTIFIED that Lumber & Sawmill Workers Union,
Local 2544, chartered by the United Brotherhood of Carpenters and
Joiners of America, affiliated with, the A. F. of L., has been desig-
nated and selected by a majority of all production and maintenance
employees of Shaw Lumber Company at its Tionesta plant, includ-
ing sawmill, box factory, machine shop, yard, planing mill, and
green chain employees, and watchmen and warehousemen, but ex-
cluding all employees engaged in logging operations, clerical, store,
sales, and supervisory employees, cook-house employees and em-
ployees of the Lawrence Warehouse Company, for the purpose of
collective bargaining, and that, pursuant to Section 9 (a) of the Act,
Lumber & Sawmill Workers Union, Local 2544, chartered by the
United Brotherhood of Carpenters and Joiners of America, affiliated
with the A. F. of, L., is the exclusive representative of all such em-
ployees.for the purposes of collective bargaining with respect to rates
of pay, wages, hours of employment and other conditions of
employment.
