In the Matter of SOUTHERN CAR AND MANUFACTURING Co. and SHOP- MEN'S LOCAL #539, INTERNATIONAL ASSOCIATION OF BRIDGE, STRUC- TURAL AND ORNAMENTAL IRON WORKERS Case No. R-2277 CERTIFICATION OF REPRESENTATIVES April 17, 1941 On February 26, 1941, the National Labor Relations Board issued its Decision and Direction of Election in the above-entitled proceed- ings.' Pursuant to the Direction of Election, an election by secret ballot was conducted on March 27, 1941, under the direction and sup- ervision of the Acting Regional Director for the Tenth Region (Atlanta, Georgia). On March 31,"1941, the Acting Regional Direc- tor, acting pursuant to Article III, Section 9, of National Labor Re- lations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties an Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. B., No.10. 45 46 DECISIONS Or NATIONAL LABOR RELATIONS BOARD of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Shopmen 's Local ' #539, International Association of Bridge , Structural and Ornamental Iron Workers, has been designated and selected by a majority of the production and maintenance employees of Southern Car and Manufacturing Com- pany, Birmingham, Alabama, excluding Graham McKinley, E. W. Wilson, and A. B. Browning, general foremen; J. R. Weston, watch- man; Lorenz Russell, clerical employee; and E. I. Crotwell , shipping clerk and timekeeper, as their representative for the purpose of col- lective bargaining, and that, pursuant to the provisions of Section 9 (a) of the National Labor Relations Act, Shopmen 's Local #539,_ International Association of Bridge , Structural and Ornamental Iron Workers, is the exclusive representative of all such employees for the purposes of collective bargaining in respect to rates of pay, wages, hours of employment , and other conditions of employment.
