In the Matter Of WESTINGHOUSE ELECTRIC & MANUFACTURING COM- PANY, EAST PITTSBURGH PLANT and LOCAL No. 601, UNITED ELECTRI- CAL, RADIO & MACHINE WORKERS OF AMERICA (CIO) Case No. R-2533 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES July 15,1941 On May 29, 1941 , the National Labor Relations Board, herein called the Board, issued its Decision and Direction of Elections in the above- entitled proceedings.' Pursuant to the Direction of Elections, elec- tions by secret ballot were conducted on June 13, 1941, under the direction and supervision of the Regional Director for the Sixth Region ( Pittsburgh, Pennsylvania ). On June 16, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued an Election Report, copies of which were duly served upon the parties. No objections to the conduct of the ballot or to the Election Report were filed by any of the parties. As to the balloting and the results thereof, the Regional Director reported as folhvs: I. The Board, in the language of a stipulation of the parties, there stated : The tool designers and machine tool designers shall be eligible to vote whether paid by salary or by the hour. If the United obtains a majority in said election, the tool designers and ma- chine tool designers shall be considered a part of the unit found appropriate by the Board in its decision in 3 N. L. R. B. 1.2 The telephone maintenance employees shall be eligible to vote whether paid by salary or by the hour. If the United obtains a majority in said election, the telephone maintenance employees shall be considered part of the unit found appropriate by the Board in its decision in 3 N. L. R. B. 1. ' The junior and senior order clerks in the shipping department shall be eligible to vote whether paid by salary or by the hour. The Board found that all hourly rate employees of the Company in its East Pittsburgh, Trafford, and Homewood, Service Works, including Linhart and Copper Mill, excluding supervisory employees, constituted a unit appropriate for the purposes of collective bargaining. If the Association obtains a majority in such election, the election group shall be considered part of the general salaried unit found appropriate by the Board in its decision in 23 N. L. R. B., No. 112.8 Upon the basis of the entire record in the, case, the Board makes the following : SUPPLEMENTAL FINDING OF FACT We find that all hourly rate employees of Westinghouse Electric & Manufacturing Company at its East Pittsburgh plant (including its plants in East Pittsburgh, Trafford, and Homewood Service Works, including Linhart and Copper Mill) East Pittsburgh, Penn- sylvania, including all tool designers and machine tool designers, telephone maintenance employees, and junior and senior order clerks in the shipping department whether paid by salary or by the hour, but excluding supervisory employees, constitute a unit appropriate for the purposes of collective bargaining, and that said unit will in- sure to employees of the Company the full benefit of their right to self-organization and to collective bargaining and otherwise effectuate the policies of the Act. Upon the basis of the above finding of fact and upon the entire record in the case, the Board makes the following : SUPPLEMENTAL CONCLUSION OF LAW All hourly rate employees of Westinghouse Electric & Manufac- turing Company at its East Pittsburgh plant, East Pittsburgh, Penn- sylvania, (including its plants in East Pittsburgh, Trafford, and Homewood Service Works, including Linhart and Copper Mill), including all tool designers and machine tool designers, telephone maintenance employees, and junior and senior order clerks in the shipping department whether paid by salary or by the hour, but excluding supervisory employees, constitute a unit appropriate for the purposes of collective bargaining, within the meaning of Section 9 (b) of the National Labor Relations Act. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Re- 8 Matter of Westinghouse Electric cf Mfg. The Board found that the salaried employees of the Company at its East Pittsburgh Unit, excluding supervisory employees , constituted a unit appropriate for the purposes of collective bargaining. 466 DECISIONS OF NATIONAL LABOR RELATIONS BOARD lations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Local No. 601, United Electrical, Radio & Machine Workers of America, affiliated with the Congress of In- dustrial Organizations, has been designated and selected by a major- ity of all hourly rate employees of Westinghouse Electric & Manu- facturing -Company at its East Pittsburgh plant, (including its plants in East Pittsburgh, Trafford, and Homewood Service Works, including Linhart and Copper Mill) East Pittsburgh, Pennsylvania, including all tool designers and machine tool designers, telephone maintenance employees, and junior and senior order clerks in the shipping department whether paid by salary or by the hour, but excluding supervisory employees, as their representative for the pur- poses of collective bargaining, and that pursuant to the provisions of Section 9 (a) -of the National Labor Relations Act, Local No. 601, United Electrical, Radio & Machine Workers of America, affiliated with the Congress of Industrial Organizations, is the exclusive rep- resentative of all such employees for the purposes of collective bar- gaining with respect to rates of pay, wages, hours of employment, and other conditions of employment.
