Case No. R-9686 SUPPLEMENTAL DECISION AND CERTIFICATION OF REPRESENTATIVES October 17, 1941 On August 8, 1941, the National Labor Relations Board, herein called the Board, issued a Decision and Direction of Election in the above-entitled proceeding.' On September 6, 1941, the Board issued an Amendment to Directon of Election.2 Pursuant to the Direction of Election, as amended, an election by secret ballot was conducted on September 19, 1941, under the direction and supervision of the Regional Director for the Second Region (New York City). On September 22, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regu- ations-Series 2, as amended, issued and duly served upon the parties an Election Report. L. R. B., No. 3. On August 21, 1941, the Board issued an order denying the request of Radio Union Local B-1010 of the International Brotherhood of Electrical Workers, A. B., No. 48. 281 282 DECISIONS OF NATIONAL LABOR RELATIONS BOARD On September 24, 1941, Local B-1010 filed with the Regional Director Objections to Conduct of Ballot and Election Report. On September 29, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regu- lations-Series 2, as amended, issued and duly served upon the parties a Report on Objections of Local B-1010 to the conduct of the ballot and the Election Report. The Board has considered the objections of Local B-1010 and finds that they do not raise substantial or material issues with respect to the conduct.of the ballot or the Election Report. The objections are hereby overruled. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Local 430 of the United Electrical, Radio & Machine Workers of America, C. I. 0., has been designated and selected by a majority of all production employees at the New York Plant of Presto Recording Corporation, New. York City, excluding clerical and supervisory employees and shipping and re- ceiving employees, as their representative for the purposes of collec- tive bargaining, and that, pursuant to Section 9 (a) of the National Labor Relations Act, Local 430 of the United Electrical, Radio & Machine Workers of America, C. I. 0., is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment. Mr. GERARD D. REILLY took no part in the consideration of the above Supplemental Decision and Certification of Representatives.
