SUPPLEMENTAL DECISION
AND
CERTIFICATION OF REPRESENTATIVES
October 28, 1941
On August 26, 1941, the National Labor Relations Board, herein
called the Board,;issued.its Decision, and, Direction of Elections in the
above entitled proceeding.)
Pursuant to the Direction of Elections,
elections by secret ballot were conducted on September 25, 1941, under
the direction and supervision of the Regional Director for the Seventh
Region (Detroit, Michigan).
On October 1, 1941, the Regional Di-
rector acting pursuant to Article III,. Section 9, of National Labor
Relations Board Rules and Regulations-Series 2, as amended, issued
his Election Report, copies of which were.duly served upon the parties.
No objections to the conduct of the ballot or to the Election Report were
filed by any of the parties.
As to the balloting and the results thereof, the Regional Director
reported as follows :

Since the number of the challenged ballots could not affect the out-
come of the elections, the Regional Director made no recommendations
thereon.
For the same reason we find it unnecessary to make any
ruling upon the challenged ballots.
On September 30, 1941, Local 2407, Steel Workers Organizing Com-
mittee, affiliated with the Congress of Industrial' Organizations, herein
called the S. W. O. C., and Local No. 46, Industrial Union, Marine
and Shipbuilding Workers of America, affiliated with the Congress
of Industrial Organizations, her
called the Marine and Shipbuild-
ing Workers, filed with the Board a motion for substitution of parties
and for an order thereon, asserting (1) ' that on July 24, 1941, at a
special meeting of, its-'membership, Local No. 2407, S. W. O. C.,
unanimously voted to transfer its affiliation from the S. W. O. C. to
the Marine and Shipbuilding Workers; (2) that on August 6, 1941,
Local No. 46 was chartered by the Marine and. Shipbuilding Workers;
(3) that on August 11, 1941, the secretary-treasurer of the S. W. O. C.'
confirmed the transfer in a letter to the secretary-treasurer of the
Marine and Shipbuilding Workers; (4) that 'the officers of the
S. W. O. C. became the officers of the Marine and Shipbuilding Work-
ers; and (5) that because of the type of work in which the members
are engaged, namely, shipbuilding and ship repairing it was deemed
advisable that the membership of Local No. 2407 should be transferred
from the S. W. O. C. to the Marine and Shipbuilding Workers.
On
October 4, 1941, the Board issued and duly served upon the 'parties
a notice that on October 11, 1941, unless sufficient cause to the con-
trary should then appear, the Board would substitute the name "Local
No. 46, Industrial' 'Union, Marine and Shipbuilding Workers of
America, affiliated with the Congress of Industrial Organizations,"
for the name "Local No. 2407, Steel Workers Organizing Commit-
tee, affiliated with the Congress of Industrial Organizations.".
On
October 9 and 10, 1941, respectively, Down River Shipbuilders Asso-
ciation, herein called the Association, and International ' Association
of Machinists, herein called the I. A. M., filed objections to the motion
and to the action proposed by the Board in its order to show cause.

On October 17, 1941, the S. W. O. C. and the Marine and Shipbuilding
Workers filed their answer .to the objections of the Association and the
I. A. M. The Board has considered the objections and finds them to
be without merit.
The motion for substitution of parties is hereby
granted and we shall accordingly certify .the Marine and Shipbuilding
Workers as the exclusive representative of the employees ; of the
Company in the appropriate unit.
In the Decision and Direction of Elections previously referred to,
the Board made no final determination as to the appropriate unit,
The Board there stated :
If the employees voting in the two- elections select the same
representative they will constitute a. single appropriate unit. If
they choose different representatives they will constitute • two
separate and distinct appropriate units.

Upon the basis of the entire record in the case, the Board makes
the following:
SUPPLEMENTAL FINDING OF FACT
We find that all employees of Great Lakes Engineering Works,
River Rouge, Michigan, excluding foremen, assistant foremen, exec-
utives, clerical and office employees, persons empowered to hire and
discharge employees, day and night watchmen, janitors, timekeepers,
and piece-work counters, constitute a unit appropriate for the purposes
of collective bargaining and that said unit will insure to employees
of the Company the full--benefit of their right to self-organization
and to collective bargaining and otherwise will effectuate the policies
of the Act.
Upon the basis of the above finding of fact and upon the entire
record in the case, the Board makes the following :
SUPPLEMENTAL CONCLUSION OF LAw
All employees of Great Lakes Engineering Works, River Rouge,
Michigan, excluding foremen, assistant foremen, executives, clerical
and office employees, persons empoy_yered to hire and discharge employ-
ees, day and night watchmen, janitors, timekeepers, and piece-work
counters, constitute a unit appropriate for the purposes of collective
bargaining, within the meaning of Section 9 (b) of the National Labor
Relations Board.
CERTIFICATION OF REPRESENTATIVES
By virtue of and pursuant to the power vested in the National Labor
Relations Board, by Section 9 (c) of the National Labor Relations

Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of
National Labor Relations Board Rules and Regulations-Series 2,
as amended,
IT IS HEREBY CERTIFIED that Local No. 46, Industrial Union, Marine
and Shipbuilding Workers of America, affiliated with the Congress
of Industrial Organizations, has been designated and selected by a
majority of all employees of Great Lakes Engineering Works, River
Rouge, Michigan, excluding foremen, assistant foremen, executives,
clerical and office employees, persons empowered to hire.and discharge
employees, day and night watchmen, janitors, timekeepers, and piece-
work counters, as their representative for the purposes of collective
bargaining, and that pursuant to the provision of Section 9 (a) of
the National Labor Relations Act, Local No. 46, Industrial Union,
Marine and Shipbuilding. Workers of America, - affiliated with the
Congress of Industrial Organizations, is the exclusive representative
of all such employees for the purposes of collective bargaining with
respect to rates of pay, wages, hours. of employment, and other
conditions of employment.
