I In the Matter Of SWIFT AND COMPANY and PACKING HOUSE INDUS- TRIAL UNION No. 11 Case No. R-3082 CERTIFICATION. OF REPRESENTATIVES December 12, 1941 On October 28, 1941, the National Labor Relations Board issued a Decision and Direction of Election in the above-entitled proceed-' ing.1 Pursuant to the Direction of Election, an election by secret ballot was conducted on November 21, 1941, under the direction and supervision of the Regional Director for the Eighteenth Region (Minneapolis, Minnesota). On November 24, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued and duly served upon the parties his Election Report. No objections to the conduct of the ballot or the Election Report have been filed by any of the parties. As to the balloting and its results, the Regional Director reported as follows : Total on eligibility list------------------------------------ 3,584 Total ballots cast---------------------------------------- 2,996 Total ballots challenged___________________________________ 8 Total blank ballots_______________________________________ 7 Total void ballots________________________________________ 13 Total valid votes cast____________________________________ 2,968 Votes cast for PACKING HOUSE INDUSTRIAL UNION No. 11___ 1, 833 Votes cast for PACKING Hous1s WORKERS ORGANIZING COM- MITTEE, C. I. 0----------------------------------------- 823 Votes cast for neither organization________________________ 312 Since the number of challenged ballots cannot affect the results of the election, the Regional Director made no report or recommenda- tion regarding said challenges, and we find it unnecessary to make any determination with respect thereto. By virtue of and pursuant to the power vested in the National Labor Relations Board by,Section 9 (c) of the National Labor Rela- tions Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, 136 N L R. B, No. 94. 558 SWIFT AND COMPANY 559 <of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that Packing House Industrial Union No. 11, has been designated and selected by a majority of all production and maintenance employees of the South St. Paul, Minnesota, plant of .Swift and Company, including truck drivers, but excluding super- intendent , assistant superintendent , division superintendents, foremen, assistant foremen , plant-protection employees (i. e., policemen , watch- men, and firemen ), Standards Department employees, time-office em- ployees, steady-time plant clerks, matrons, hostess , head cooks, chem- ists, all General Office employees, bricklayers , plant administrative employees, office cafeteria employees, and steady-time scalers, as their representative for the purposes of collective bargaining , and that, pursuant to Section 9 (a) of the National Labor Relations Act, Pack- ing House Industrial Union No. 11 , is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay , wages, hours of employment, and other con- ditions of employment.
