In the Matter of GENERAL MOTORS CORPORATION and 'AMERICAN PowER ASSOCIATION, INDEPENDENT Case No. R-2965 SUPPLEMENTAL DECISION, ORDER AND CERTIFICATIONS OF REPRESENTATIVES December 03, 1941 On October 28 and November 10, 1941, respectively,' the National Labor Relations Board issued its Decision and Direction of Elections 1 in the above-entitled proceeding. Pursuant to the Direction of Elec- tions, as amended, elections by secret ballot were conducted on Novem- ber 18, 1941, under the direction and supervision of the Reginal Direc- tor for the Seventh Region (Detroit, Michigan). On November 22,, 1941, the Regional Director, acting pursuant to Article III, Section 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, issued his Elections Report, copies of which were duly served upon the parties. No objections to the conduct of the,ballot or to the Elections Report were filed by any of the parties. The petition for investigation and certification of representatives insofar as it concerns the employees in this unit will therefore be dismissed. ORDER By virtue of Section 9 (c) of the National Labor Relations Act, 49 Stat. 449, and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT Is HEREBY ORDERED that the petition for investigation and certifi- cation of representatives of employees of General Motors Corporation, Detroit, Michigan, filed by American Power Association, Independent, insofar as it concerns the employees of the Company's Ternstedt Manufacturing Division be, and it hereby is, dismissed. CERTIFICATION OF REPRESENTATIVES By virtue of and pursuant to the power vested in the National Labor Relations Board by Section 9 (c) of the National Labor Relations Act, 49 Stat. 449 , and pursuant to Article III, Sections 8 and 9, of National Labor Relations Board Rules and Regulations-Series 2, as amended, IT IS HEREBY CERTIFIED that United Automobile Workers of America, affiliated with the Congress of Industrial Organizations , has been des- 876 DECISIONS OF NATIONAL LABOR RELATIONS BOARD ignated and selected by a majority of all shift operating engineers employed at the powerhouse of General Motors Corporation's Fisher Body Division, Plant No. 10, Detroit, Michigan, excluding the chief engineers and assistant chief engineers, as their representative for the purposes of collective bargaining and that pursuant to Section 9 (a) of the Act, United Automobile Workers of America, affiliated with the Congress of Industrial Organizations , is the exclusive representa- tive of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment, and other conditions of employment; •and IT IS HEREBY CERTIFIED .,that American Power Association, Inde- pendent, has been designated and selected by a majority of all shift operating engineers employed at the powerhouse of General Motors Corporation's Fisher Body Division , Plant No. 23, Detroit, Michigan, excluding chief engineers and assistant chief engineers, as their rep- resentative for the purposes of collective bargaining and that pur- suant to Section 9 (a) of the Act, American Power Association, Inde- pendent, is the exclusive representative of all such employees for the purposes of collective bargaining with respect to rates of pay, wages, hours of employment , and other conditions of employment.
