Liability

1.5-Liability Each Party is indemnified and protected by limitations on liability according to the terms of its respective contract with CMS. Except with respect to a breach of the confidentiality provision set forth in section 1.6 below, titled “Mutual Confidentiality”, this JOA shall not be construed to give rise to any binding obligation, rights, duty or liability, of any kind whatsoever, of any Party to this JOA to any other party.
