9065.3 – Right to an Administrative Review (Rev. 24, Issued: 02-12-16, Effective: 03-14-16, Implementation: 03-14-16) A practitioner or other person dissatisfied with an OIG determination or an exclusion that resulted from a determination not being made within 120 days is entitled to a hearing before an ALJ in accordance with §205(b) of the Act. If the practitioner or other person is dissatisfied with the ALJ’s decision, he/she may appeal that decision and obtain a final determination from the Department Appeals Board (DAB). (See 42 CFR §1005.21.)
