150.2 - Payment for Services Rendered On or After April 1, 1994, by Noncontracted, Nonparticipating Physicians (Rev. 4, 10-01-01) If a noncontracted physician provides a service to one of the cost-based HMO/CMP’s enrollees, and the physician is not a Medicare participating physician, the limit of the HMO/CMP’s liability is the lower of the actual charge or the limiting charge permitted under the statute for FFS Medicare. The HMO/CMP is responsible for beneficiary coinsurance and deductible payments.
