370.2 - Disability (Rev. 4, 10-01-01) Section 1862(b)(1)(B)(i) of the Act provides that a LGHP may not take into account that a disabled active individual is entitled to Medicare based on disability. The term “active individual” means an employee, the employer, self-employed individual (such as the employer), an individual associated with the employer in a business relationship, or a member of the family of any such persons.
