130.8 - Appeal and Anti-Discrimination Rights (Rev. 77, Issued: 10-28-05, Effective Date: 10-28-05) A Medicare cost plan may not condition the provision of care or otherwise discriminate against an individual based on whether or not the individual has executed an advance directive. Furthermore, the Medicare cost plan must inform individuals that complaints concerning noncompliance with the advance directive requirements may be filed with the State Survey and Certification Agency.
