50.7 – Beneficiary Right to Request Waiver of Medicare’s Claim (Rev. 12438; Issued: 01-04-24; Effective: 02-06-24; Implementation: 02-06-24) The MSP Contractor must inform the beneficiary that he or she has the right to request waiver of adjustment or recovery of the overpayment, and/or to appeal the existence of an overpayment, the amount of the mistaken payment, or the denial of waiver of conditional payment. This notice (right to request appeal and/or waiver of recovery) must be given at the time repayment is requested from the beneficiary.
