10005.23 - Settlement of Civil Money Penalty (Rev. 221; Issued: 05-10-24; Effective: 05-10-24; Implemetation:05-10-24) The CMS Location has the authority to settle CMP cases at any time prior to a final administrative decision. If a decision is made to settle, the settlement should not be for a better term than had the HHA or hospice program opted for a 35 percent reduction.
