10005.26 - Disbursement of Recovered CMP funds (Rev. 221; Issued: 05-10-24; Effective: 05-10-24; Implemetation:05-10-24) The CMP amounts and any corresponding interest recovered from HHAs, and hospice programs will be divided between the Medicare and Medicaid programs, based on a proportion that is commensurate with the comparative Federal expenditures under Titles XVIII and XIX of the Act, using Medicaid Statistical Information System (MSIS) and HHA or hospice program Prospective Payment System (PPS) data for a three-year fiscal period. The amounts are disbursed in accordance with § 488.845(g). Penalty funds may not be used for survey and certification operations nor can they be used as the State’s Medicaid non- Federal medical assistance or administrative match. The CMS Locations are not responsible for disbursement of recovered CMP funds.
