5.1 – Home Use of DME, Prosthetics, Orthotics, and Supplies (DMEPOS) (Rev. 10190; Issued: 06-19-2020; Effective: 01-01-2020; Implementation: 07-01- 2020) The Social Security Act (the Act) defines those items and services covered by Medicare and identifies certain conditions for payment. In Section 1834(a)(11) of the Act, Congress sets forth prescription and face-to-face encounter requirements for certain items. We note that Section 1834(h)(3) of the Act requires that section 1834(a)(11) of the Act apply to orthotics and prosthetics in the same manner as it applies to items of DME.
