Former §2A3.6, comment. (n.4) (Upward departure): In a case in which the guideline sentence is determined under subsection (a),[3] a sentence above the minimum term required by 18 U.S.C. § 2250(d) [(Failure to register)] is an upward departure from the guideline sentence. A departure may be warranted, for example, in a case involving a sex offense committed against a minor or if the offense resulted in serious bodily injury to a minor. USSG §2A3.6(a) (Nov. 2024) provided: “[i]f the defendant was convicted under . . . 18 U.S.C. § 2250(d), the guideline sentence is the minimum term of imprisonment required by statute.” 5.
