What is a new municipal waste combustor?

(a) A new municipal waste combustor meets either of two criteria: (1) Commenced construction after January 23, 2024. (2) Commenced reconstruction or modification after September 10, 2026. (b) This subpart does not apply to your municipal waste combustor if you make physical or operational changes to an existing municipal waste combustor primarily to comply with the emission guidelines in subpart WWWW of this part. Such changes do not qualify as reconstruction or modification under this subpart.
