What happens if the Board remands the case to the presiding officer?

If the Board issues a decision remanding a case to the presiding officer, the presiding officer: (a) May, subject to any directions or restrictions in the Board's decision and § 4.315, do one or more of the following to resolve any issues of fact or law: (1) Request information from the Project Director and the parties in interest or other persons or entities; (2) Schedule and hold a prehearing conference; (3) Schedule and hold a hearing; or (4) Take any other action authorized by this subpart; and (b) Will issue an order upon remand determining the issues of fact or law.
