Definitions.

As used in this subpart:
(a)
Act
means the Fluid Milk Promotion Act of 1990 (Subtitle H of Title XIX of the Food, Agriculture, Conservation, and Trade Act of 1990, Pub. L. 101-624, 7 U.S.C. 6401-6417) and any amendments thereto.
(b)
Department
means the United States Department of Agriculture.
(c)
Secretary
means the Secretary of Agriculture of the United States or any officer or employee of the Department to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in the Secretary's stead.
(d)
Administrator
means the Administrator of the Agricultural Marketing Service, with power to redelegate, or any officer or employee of the Department to whom authority has been delegated or may hereafter be delegated to act in the Administrator's stead.
(e)
Order
means a Fluid Milk Promotion Order, and any amendments thereto, authorized by the Act.
(f)
Board
means the National Fluid Milk Processor Promotion Board established pursuant to the Act.
(g)
Assessment
means the monies that are collected and remitted to the Board pursuant to the Act.
(h)
Person
means any individual, group of individuals, partnership, corporation, association, cooperative association or other entity.
(i)
Fluid milk processor
means any person who is defined as a fluid milk processor under the order, or under the proposed order on which the initial referendum is held.
(j)
Referendum agent
means the person designated by the Secretary to conduct the referendum.
(k)
Representative period
means the period designated by the Secretary pursuant to Sections 1999N and 1999O of the Act.
