As approved: Resolved (two-thirds of the Senators present concurring therein), Section 1. Senate Advice and Consent Subject to a Declaration and a Condition. The Senate advises and consents to the ratification of the Protocol to the North Atlantic Treaty of 1949 on the Accession of the Republic of Albania, adopted at Brussels on July 9, 2008, and signed that day on behalf of the United States of America (the "Protocol") (Treaty Doc. 110- 20), subject to the declaration of section 2 and the condition of section 3. Section 2. Declaration The advice and consent of the Senate under section 1 is subject to the following declaration: (a) Article 10 of the North Atlantic Treaty provides that Parties may, by unanimous agreement, invite any other European State in a position to further the principles of the North Atlantic Treaty and to contribute to the security of the North Atlantic area to accede to the North Atlantic Treaty, and thus become a member of the North Atlantic Treaty Organization ("NATO"). (b) The Bucharest Summit Declaration, issued by the Heads of States and Governments participating in the meeting of the North Atlantic Council in Bucharest on April 3, 2008, states that NATO welcomes Ukraine's and Georgia's Euro-Atlantic aspirations for membership in NATO. The Bucharest Summit Declaration additionally states that it was "agreed today that these countries will become members of NATO." (c) The Senate declares that it is important that NATO keep its door open to all European democracies willing and able to assume the responsibilities and obligations of membership. Section 3. Condition The advice and consent of the Senate under section 1 is subject to the following condition: Presidential Certification Prior to the deposit of the instrument of ratification, the President shall certify to the Senate as follows: 1. The inclusion of the Republic of Albania in NATO will not have the effect of increasing the overall percentage share of the United States in the common budgets of NATO; and 2. The inclusion of the Republic of Albania in NATO does not detract from the ability of the United States to meet or to fund its military requirements outside the North Atlantic area.
