MODIFICATION OF MINOR CONSTRUCTION THRESHOLD FOR PLANT PROJECTS.

SEC. 3118. MODIFICATION OF MINOR CONSTRUCTION THRESHOLD FOR PLANT PROJECTS.(a) Increase.—Paragraph (3) of section 4701 of the Atomic Energy Defense Act (50 U.S.C. 2741(3)) is amended by striking “$5,000,000” and inserting “$10,000,000”.(b) Sunset.—Effective September 30, 2010, such paragraph, as amended by subsection (a), is amended by striking “$10,000,000” and inserting “$5,000,000”.(c) Notification.—Notwithstanding section 4703 of such Act (50 U.S.C. 2743), in carrying out construction projects during fiscal year 2010, the Secretary of Energy may not start a general plant project with a total estimated cost of more than $5,000,000 until—(1) the Secretary notifies the congressional defense committees of such project and total estimated cost; and(2) a period of 15 days has elapsed after the date on which such notification is received.
