SEC. 8010. RULE FOR DEEMING TO CHILDREN THE INCOME AND RESOURCES OF THEIR PARENTS WAIVED FOR CERTAIN DISABLED CHILDREN. (a) In General.—Section 1614(f)(2) (42 U.S.C. 1382c(f)(2)) is amended— (1) by inserting “(A)” after “(2)”; and (2) by adding at the end the following: “(B) Subparagraph (A) shall not apply in the case of any child who has not attained the age of 18 years who— “(i) is disabled; 103 STAT. 2464 “(ii) received benefits under this title, pursuant to section 1611(e)(1)(B), while in an institution described in section 1611(e)(1)(B); “(iii) is eligible for medical assistance under a State home care plan approved by the Secretary under the provisions of section 1915(c) relating to waivers, or authorized under section 1902(e)(3); and “(iv) but for this subparagraph, would not be eligible for benefits under this title.”. (b) Personal Needs Allowance.—Section 1611(e)(1)(B) (42 U.S.C. 1382(e)(1)(B)) is amended by inserting “or an eligible individual is a child described in section 1614(f)(2)(B),” before “the benefit under this title”. (c) Effective Date.—The amendments made by subsections (a) and (b) shall take effect on the 1st day of the 6th calendar month beginning after the date of the enactment of this Act.
