RETURN ON EQUITY PAYMENTS TO OUTPATIENT DEPARTMENTS.

SEC. 4065. RETURN ON EQUITY PAYMENTS TO OUTPATIENT DEPARTMENTS. (a) In General.— Section 1861(v)(1) of the Social Security Act (42 U.S.C. 1395x(v)(1)) is amended by adding at the end thereof the following new subparagraph: “(S) Such regulations shall not include provision for specific recognition of any return on equity capital with respect to hospital outpatient departments.”. (b) Conforming Amendment.— Section 1881(b)(2)(C) of such Act (42 U.S.C. 1395rr(b)(2)(C)) is amended by striking “facilities” and inserting “facilities (other than hospital outpatient departments)”. (c) Effective Date.— The amendments made by this section shall become effective on January 1, 1988.
