Coast Guard operating expenses Notwithstanding any other provision of law, in fiscal year 1989 and thereafter, sums provided by any party, including sums provided in advance, as reimbursements for operating expenses incurred by the United States Coast Guard in response to the oilspill from the “Exxon Valdez” grounding, shall be credited to the “Operating expenses” appropriation for the United States Coast Guard, and shall remain available until expended. From funds made available under this head in Public Law 100–457, up to $5,600,000 shall be made available until expended for development, acquisition, installation, operation, and support, including personnel, or equipment to provide vessel traffic management information in the New York Harbor area: Provided, That the United States Coast Guard shall initiate action within sixty days of the date of enactment of this Act to establish such a system: Provided further, That, within sixty days of the date of enactment of this Act, the Secretary shall initiate a rulemaking to determine which class or classes of vessels operating in the New York Harbor area shall be required to participate in an active vessel traffic management system, and the specific operating procedures and requirements of such a mandatory system. Notwithstanding any other provision of law, funds available under this head in both Public Law 100–457 and this Act shall be available for expenses incurred in fiscal year 1989 by the Coast Guard in responding to any oilspill.
