SEC. 2819. ACCESS TO MILITARY INSTALLATIONS BY TRANSPORTATION NETWORK COMPANIES. Section 346 of the National Defense Authorization Act for Fiscal Year 2017 (Public Law 114–328) is amended—(1) in the section heading, by inserting “and transportation network companies” after “transportation companies”;(2) in subsections (b), (c), and (d), by inserting “or transportation network company” after “transportation company” each places it appears;(3) in subsection (b)(7), by inserting “and transportation network companies” after “transportation companies”; and(4) in subsection (d)—(A) by redesignating paragraph (2) as paragraph (3);(B) by striking paragraph (1) and inserting the following new paragraphs:“(1) Transportation company.—The term ‘transportation company’ means a corporation, partnership, sole proprietorship, or other entity outside of the Department of Defense that provides a commercial transportation service to a rider.“(2) Transportation network company.—The term ‘transportation network company’—“(A) means a corporation, partnership, sole proprietorship, or other entity, that uses a digital network to connect riders to covered drivers in order for the driver to transport the rider using a vehicle owned, leased, or otherwise authorized for use by the driver to a point chosen by the rider; and“(B) does not include a shared-expense carpool or vanpool arrangement that is not intended to generate profit for the driver.”; and(C) in subparagraph (A)(i) of paragraph (3), as redesignated by subparagraph (A) of this paragraph, by inserting “or transportation network company” after “transportation company”.
