SEC. 9124. NATURAL DISASTER REGULATION. Title VI of the Federal Aviation Act of 1958 (49 U.S.C. App. 1421–1432) is amended by inserting after section 612 the following new section: “SEC. 613. SAFETY REGULATION. “(a) National Disaster Areas.—Before the 180th day following the date of the enactment of this section, the Administrator, for safety and humanitarian reasons, shall issue such regulations as may be necessary to prohibit or otherwise restrict aircraft overflights of any inhabited area which has been declared a national disaster area in the State of Hawaii. “(b) Exceptions.—Regulations issued pursuant to subsection (a) shall not be applicable in the case of aircraft overflights involving an emergency or a ligitimate 7373 So in original. Probably should be “legitimate”. scientific purpose. “(c) Status of Studies.—Not later than the 90th day following the date of the enactment of this section, the Administrator shall report to Congress on the status of the studies and reports required by the Act entitled ‘An Act to require the Secretary of the Interior to conduct a study to determine the appropriate minimum altitude for aircraft flying over national airport system units’, approved August 18, 1987 (101 Stat. 674–678; 16 U.S.C. 1a–1 note).”.
