PROCEDURES APPLICABLE TO MULTIYEAR PROCUREMENT CONTRACTS

SEC. 808. PROCEDURES APPLICABLE TO MULTIYEAR PROCUREMENT CONTRACTS (a) Cost Determinations.— Paragraph (1) of section 2306(h) of title 10, United States Code, is amended— (1) in the matter preceding subparagraph (A), by striking out “(other than contracts described in paragraph (6))”, and (2) in subparagraph (A), by striking out “reduced total costs under the contract” and inserting in lieu thereof “substantial savings of the total anticipated costs of carrying out the program through annual contracts”. (b) Exemptions.— Paragraph (6) of such section is amended by striking out “contracts for the construction, alteration, or major repair of improvements to real property or”. (c) Requirements With Respect to Specifically Authorized Programs.— Paragraph (9) of such section is amended— (1) by inserting “for a defense acquisition program that has been specifically authorized by law to be carried out using multiyear contract authority” in the matter preceding subparagraph (A) after “under this subsection”; and (2) by striking out subparagraph (C).
