SEC. 509. Determinations.REMOTE APPEARANCE BEFORE A BOARD OF INQUIRY.(a) Regular Officers.—Section 1185 of title 10, United States Code, is amended—(1) in subsection (a)(3), by striking “shall be” and inserting “subject to subsection (c), shall be”; and (2) by adding at the end the following new subsection:“(c) The Secretary concerned may determine that, in exceptional circumstances, the appearance of an officer before the proceedings of a board of inquiry may be via means other than in person.” . (b) Reserve Officers.—Section 14904 of title 10, United States Code, is amended—(1) in subsection (a)(3), by striking “shall be” and inserting “subject to subsection (c), shall be”; and (2) by adding at the end the following new subsection:“(c) Remote Appearance.—The Secretary concerned may determine that, in exceptional circumstances, the appearance of an officer before the proceedings of a board of inquiry may be via means other than in person.” .
