Sec. 239. (a) Except as otherwise provided by this Act, the appropriate Secretary may release any member of the reserve components from active duty or active duty for training at any time. (b) In time of war or national emergency hereafter declared by the Congress, or in time of national emergency hereafter proclaimed by the President, a member of a reserve component who is serving on active duty, shall not be released from active duty except on the approved recommendation of a board of officers convened by competent authority if he requests such action: Provided, That the provisions of this subsection shall not be applicable to any Armed Force during a period of demobilization or reduction in strength of any such Armed Force.
