SEC. 2236. SUGARCANE. (a) 1990 Crop.— Effective only for the 1990 crop of sugarcane, section 201(k)(2) of the Agricultural Act of 1949 (7 U.S.C. 1446(k)(2)) is amended— (1) by inserting “(A)” after the paragraph designation; and (2) by adding at the end the following paragraph: “(B) (i) If, because of frost, freeze, or related condition in 1989 constituting a major disaster or emergency declared by the President in the State of Louisiana under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et seq.), the total quantity of the 1990 crop of sugarcane that the producers are able to harvest on any farm is less than— “(I) 60 percent of the county average yield, as determined by the Secretary, for the crop, multiplied by “(II) the acreage planted for harvest to the crop, the Secretary shall make a reduced yield disaster payment to104 STAT. 3962 the producers at a rate equal to 50 percent of the loan level for the crop for the deficiency in production greater than 60 percent for the crop. “(ii) The Secretary shall ensure that no producer receives duplicative payments under this subparagraph. “(iii) Any benefits or assistance provided for under this section shall be provided only to the extent provided for in advance in appropriations Acts. There are authorized to be appropriated such sums as may be necessary to carry out this subparagraph.”.
