§ 5592. Regular Navy: Civil Engineer Corps: maximum number of ensigns appointed annually (a) Subject to subsection (b), the maximum number of appointments that may be made in any year to the active list of the Navy in the Civil Engineer Corps in the grade of ensign is equal to 3 percent of the number of appointments made that year to the active list in the line in the grade of ensign. (b) If, in any year, the number of officers on the active list in the Civil Engineer Corps is less than 3 percent of the number of officers on the active list in the line, the number of appointments in 328 that year to the active list in the Civil Engineer Corps in the grade of ensign may be increased as the President determines necessary, so long as that percentage is not exceeded.
