SEC. 312. THE ELEMENTARY AND SECONDARY EDUCATION ACT OF 1965. Subsection (c) of section 1221 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 279l(c)) is amended by adding at the end thereof the following new paragraph: “(3) Special rule.—Notwithstanding any other provision of law, for purposes of determining the amount of a grant under this subsection for which a State educational agency is eligible from funds appropriated for the program assisted under this subpart for each fiscal year beginning after October 1, 1990, the Secretary shall allow intermediate school districts to count children with disabilities in the srune manner as such children were counted in determining such amount in fiscal year 1990, regardless of whether such children receive services directly from the intermediate school district.”.
