§ 20–366. Resignation; petition; accounting; liability Where a person, after having accepted the office of executor or administrator, desires to resign the office, he may file his petition to that effect, accompanied by a full and particular account, under oath, of his receipts and disbursements, if any. The court shall thereupon direct such notice as it deems proper to be given of the application, and, if cause is not shown to the contrary, may release and discharge him from his office and enter such order as to costs and commissions and impose such terms in other respects as the nature of the case requires. The executor or administrator is not, by the discharge, released from liability for past acts, defaults, or omissions of duty.
