SEC. 715. STATEMENTS REGARDING THE NONAVAILABILITY OF HEALTH CARE. (a) Consideration of Availability of Contract Care.—Chapter 55 of title 10, United States Code, is amended by adding at the end the following new section: “§ 1105. Issuance of nonavailability of health care statements “In determining whether to issue a nonavailability of health care statement for any person entitled to health care in facilities of the uniformed services under this chapter, the commanding officer of such a facility may consider the availability of health care services for such person pursuant to any contract or agreement entered into under this chapter for the provision of health care services within the area served by that facility.”. (b) Clerical Amendment.—The table of sections at the beginning of such chapter is amended by adding at the end the following new item: “1105. Issuance of nonavailability of health care statements.”.
