Sec. 210. Positions which are financed by appropriations in this Act which are determined by the Secretary of Transportation to be essential to assure public safety and which are assigned to facilities directly engaged in the operation or maintenance of the air traffic control system or the air navigation system of the Federal Aviation Administration may be filled without regard to the provisions of section 201 of Public Law 90–364, and such positions shall not be taken into consideration in determining numbers of employees under subsection (a) of that section or numbers of vacancies under subsection (b) of that section. This Act may be cited as the “Department of Transportation Appropriation Act, 1969”.
