SEC. 1035. LIMITATION ON DISCOVERY OF CERTAIN REPORTS AND SURVEYS. (a) In General.— Section 409 of title 23, United States Code, is amended— (1) by striking the section heading and inserting the following: “§ 409. Discovery and admission as evidence of certain reports and surveys”; and (2) by striking “admitted into evidence in Federal or State court” and inserting “subject to discovery or admitted into evidence in a Federal or State court proceeding”. (b) Conforming Amendment.— The analysis for chapter 4 of such title is amended by striking the item relating to section 409 and inserting the following: “409. Discovery and admission as evidence of certain reports and surveys.”.
