changes in existing law; related provisions Sec. 477. (a) There are hereby repealed— (1) the first section of the Act entitled “An Act to increase clerk hire, and for other purposes”, approved December 20, 1944 (58 Stat. 831; Public Law 512, Seventy-eighth Congress; 2 U.S.C. (2) section 11(a) of the Legislative Branch Appropriation Act, 1956 (2U.S.C. 60g–1); and (3) section 202(e) of the Legislative Reorganization Act of 1946 (2 U.S.C. 72a (e)). (b) All provisions of law inconsistent with any provision of this Part are hereby superseded to the extent of the inconsistency. (c) (1) This subsection is enacted as an exercise of the rulemaking power of the House of Representatives subject to and with full recognition of the power of the House of Representatives to enact or change any Rule of the House at any time in its exercise of its constitutional right to determine the rules of its proceedings. (2) Clause 29(c) of Rule XI of the Rules of the House of Representatives is amended to read as follows: “(c) Each employee on the professional staff, and each employee on the clerical staff, of each standing committee, is entitled to pay at a single per annum gross rate, to be fixed by the chairman, which does not exceed the highest rate of basic pay, as in effect from time to time, of the General Schedule of section 5332(a) of title 5, United States Code.”. (d) Section 5533(c) of title 5, United States Code, is amended to read as follows: “(c) (1) Unless otherwise authorized by law and except as otherwise provided by paragraph (2) of this subsection, appropriated funds are not available for payment to an individual of pay from more than84 Stat. 1196 one position if the pay of one of the positions is paid by the Secretary of the Senate or the Clerk of the House of Representatives, or one of the positions is under the Office of the Architect of the Capitol, and if the aggregate gross pay from the positions exceeds $7,724 a year. “(2) Notwithstanding paragraph (1) of this subsection, appropriated funds are not available for payment to an individual of pay from more than one position, for each of which the pay is disbursed by the Clerk of the House of Representatives, if the aggregate gross pay from those positions exceeds the maximum per annum gross rate of pay authorized to be paid to an employee out of the clerk hire allowance of a Member of the House. “(3) For the purposes of this subsection, ‘gross pay’ means the annual rate of pay (or equivalent thereof in the case of an individual paid on other than an annual basis) received by an individual.”.
