TREATMENT OF ACCRUED LEAVE OF MEMBERS WHO DIE WHILE ON ACTIVE DUTY
SEC. 309. TREATMENT OF ACCRUED LEAVE OF MEMBERS WHO DIE WHILE ON ACTIVE DUTY (a) Survivors Eligible for Payment for All Accrued Leave of Member.— In the case of a member of the uniformed services who dies as a result of an injury or illness incurred while serving on active duty during the Persian Gulf conflict, the limitation in the second sentence of subsection (b)(3) of section 501 of title 37, United States Code, and in subsection (f) of that section shall not apply with respect to a payment made pursuant to subsection (d) of that section for leave accrued during fiscal year 1990 or 1991. (b) Technical Amendment.— Section 1115(a) of the National Defense Authorization Act for Fiscal Year 1991 (Public Law 101–510; 104 Stat. 1636) is amended by striking out “section 501(b)(3) of title 37, United States Code, does not apply” and inserting in lieu thereof “subsection (b)(3) of section 501 of title 37, United States Code, and in subsection (f) of that section does not apply”. (c) Effective Date.— The amendment made by subsection (b) shall take effect as of November 5, 1990.
