(a) Section 1861 (p) of the Social Security Act is amended by adding at the end thereof the following new sentence: “The term ‘outpatient physical therapy services’ also includes speech pathology services furnished by a provider of services, a clinic, rehabilitation agency, or by a public health agency, or by others under an arrangement with, and under the supervision of, such provider, clinic, rehabilitation agency, or public health agency to an individual as an outpatient, subject to the conditions prescribed in this subsection.”. (b) Section 1835(a) (2) of such Act (as amended by section 251 of this Act) is further amended— (1) by striking out the period at the end of subparagraph (C) and inserting in lieu thereof “; and”; and (2) by adding after subparagraph (C) the following new subparagraph: “(D) in the case of outpatient speech pathology services, (i) such services are or were required because the individual needed speech pathology services (ii) a plan for furnishing such services has been established and is periodically reviewed by a physician, and (iii) such services are or were furnished while the individual is or was under the care of a physician.”. (c) The provisions of this section shall apply with respect to services rendered after December 31, 1972.
