(a) Section 209(b) of the Federal Railroad Safety Act of 1970 (45 U.S.C. 438(b)) is amended by inserting after “for violation thereof” and before “in such amount” the following: “or for violation of section 2 of the Act of May 6, 1910 (45 U.S.C. 39)”. 88 Stat. 2166 (b) Section 2 of the Act of May 6, 1910 (45 U.S.C. 89) is amended by adding at the end thereof the following new sentence: “In lieu of the foregoing, any such carrier may be required to pay a civil penalty pursuant to subsections (b) and (c) of section 209 of the Federal Railroad Safety Act of 1970 (45 U.S.C. 438(b)).”.
