Sec. 106. Section 620 of title 38, United States Code, is amended by— (1) inserting in subsection (a) “and except as provided in subsection (e)” after “subsection (b)”; (2) striking out “40 per centum” and inserting in lieu thereof “45 per centum” in clause (ii) of subsection (a); (3) inserting before the period at the end of clause (ii) of subsection (a) a comma and “or not to exceed 50 per centum of such cost where determined necessary by the Administrator, upon recommendation of the Chief Medical Director, to provide adequate care”; and (4) inserting at the end thereof the following new subsection: “(e) For the purposes of this section, the term ‘nursing home care’ includes intermediate care, as determined by the Administrator in accordance with regulations which the Administrator shall prescribe. The cost of intermediate care for purposes of payment by the United States pursuant to subsection (a) (ii) of this section shall be determined by the Administrator except that the rate of reimbursement shall be commensurately less than that provided for nursing home care (as defined in section 101(28) of this title),”.
